WASHINGTON (AP) ? The top Senate negotiators on the effort to prevent the government from going over the "fiscal cliff" offered a pessimistic assessment Sunday, barely 24 hours before a deadline to avert tax hikes on virtually every American worker. But negotiations continued, with Vice President Joe Biden taking on a new role.

With the two sides differing on the income threshold for higher tax rates and how to deal with inheritance taxes, among other issues, talks between Senate Majority Leader Harry Reid, D-Nev., and Senate Republican leader Mitch McConnell appeared to have broken down. A McConnell spokesman said the Kentucky Republican reached out to Biden, a longtime friend, in hopes of breaking the impasse.

Republicans withdrew a long-discussed proposal to slow future cost-of-living increases for Social Security recipients as part of a compromise to avoid the cliff. Democrats said that proposal had put a damper on the talks, and Republican senators emerging from a closed-door GOP meeting said it is no longer part of the equation.

Aides said the two sides remained at odds over the income threshold for higher tax rates, tax levels on large estates and whether Democratic demands for new money to prevent a cut in Medicare payments to doctors and renew jobless benefits for the long-term unemployed should be financed with cuts elsewhere in the budget. The aides demanded anonymity because of the sensitivity of the negotiations.

At stake are sweeping tax hikes and across-the-board spending cuts set to take effect at the turn of the year. Taken together, they've been dubbed the fiscal cliff, and economists warn the one-two punch ? which leaders in both parties have said they want to avoid ? could send the still-fragile economy back into recession.

Reid said he's been in frequent contact with President Barack Obama, who in a televised interview blamed Republicans for putting the nation's shaky economy at risk.

"We have been talking to the Republicans ever since the election was over," Obama said in the interview that was taped Saturday and aired Sunday on NBC's "Meet the Press." ''They have had trouble saying yes to a number of repeated offers."

"The mood is discouraged," said Sen. Joe Lieberman, a Connecticut independent who caucuses with Democrats. He said he would be shocked if there was a deal Sunday. "The parties are much further apart than I hoped they'd be by now."

The pessimistic turn came as the House and Senate returned to the Capitol for a rare Sunday session. Reid and McConnell had hoped to have a blueprint to present to their rank and file by mid-afternoon.

"I'm concerned with the lack of urgency here. There's far too much at stake," McConnell said. "There is no single issue that remains an impossible sticking point ? the sticking point appears to be a willingness, an interest or courage to close the deal."

Reid said he is not "overly optimistic but I am cautiously optimistic," but reiterated that any agreement would not include the less generous inflation adjustment for Social Security.

"We're willing to make difficult concessions as part of a balanced, comprehensive agreement, but we'll not agree to cut Social Security benefits as part of a small or short-term agreement," Reid said.

McConnell and Reid were hoping for a deal that would prevent higher taxes for most Americans while letting rates rise at higher income levels, although the precise point at which that would occur was a major sticking point.

Obama had wanted to raise the tax rate on individuals making more than $200,000 a year and families making more than $250,000 from 35 percent to 39.6 percent. In talks with Republican House Speaker John Boehner, he offered to raise that threshold to $400,000.

The estate tax issue was particularly tricky since several Democrats, including veterans like Max Baucus of Montana, disagree with Obama's proposal to increase the top estate tax rate from 35 percent to 45 percent.

Republicans said Democrats pressed to turn off more than $200 billion in the across-the-board spending cuts over the coming two years. This so-called sequester is the punishment for last year's deficit "supercommittee" to strike a deal.

Hopes for blocking across-the-board spending cuts were fading and Obama's proposal to renew the 2-percentage-point payroll tax cut wasn't even part of the discussion.

Obama pressed lawmakers to start where both sides say they agree ? sparing middle-class families from looming tax hikes.

"If we can get that done, that takes a big bite out of the fiscal cliff. It avoids the worst outcomes. And we're then going to have some tough negotiations in terms of how we continue to reduce the deficit, grow the economy, create jobs," Obama said in the NBC interview.

Gone is the talk of a grand deal that would tackle broad spending and revenue demands and set the nation on a course to lower deficits. Obama and Boehner were once a couple hundred billion dollars apart on a deal that would have reduced the deficit by more than $2 trillion over 10 years.

Republicans have complained that Obama has demanded too much in tax revenue and hasn't proposed sufficient cuts or savings in the nation's massive health care programs.

Obama upped the pressure on Republicans to negotiate a fiscal deal, arguing that GOP leaders have rejected his past attempts to strike a bigger and more comprehensive bargain.

"The offers that I've made to them have been so fair that a lot of Democrats get mad at me," Obama said.

Boehner disagreed, saying Sunday that the president had been unwilling to agree to anything "that would require him to stand up to his own party."

The trimmed ambitions of today are a far cry from the upbeat bipartisan rhetoric of just six weeks ago, when the leadership of Congress went to the White House to set the stage for negotiations to come.

But the deal in the works Sunday was not meant to settle other outstanding issues, including more than $1 trillion in cuts over 10 years, divided equally between the Pentagon and other government agencies. The deal also would not address an extension of the nation's borrowing limit, which the government is on track to reach any day but which the Treasury can put off through accounting measures for about two months.

That means Obama and the Congress are already on a new collision path. Republicans say they intend to use the debt ceiling as leverage to extract more spending cuts from the president. Obama has been adamant that unlike 2011, when the country came close to defaulting on its debts, he will not yield to those Republican demands.

Meanwhile, a senior defense official said if the sequester were triggered, the Pentagon would soon begin notifying its 800,000 civilian employees that they should expect some furloughs ? mandatory unpaid leave, not layoffs. It would then take some time for the furloughs to begin being implemented, said the official, who requested anonymity because the official was not authorized to discuss the internal preparations.

Lawmakers have until the new Congress convenes to pass any compromise, and even the calendar matters. Democrats said they had been told House Republicans might reject a deal until after Jan. 1, to avoid a vote to raise taxes before they had technically gone up, and then vote to cut taxes after they had risen.

UFC 155 results: Junior dos Santos shows many admirable traits in decisive defeat

The resilience, heart and durability of Junior dos Santos were all relatively unknown attributes coming into UFC 155 last night (Dec. 29, 2012), but thanks to a savage Cain Velasquez mauling, fight fans now know that "Cigano" possesses the grit and mettle that can make a good mixed martial arts (MMA) fighter a great one.

Despite getting drubbed in a decision loss to the overwhelming Cain Velasquez at UFC 155 last night (Dec. 29, 2012), losing his heavyweight title belt in the process, Junior dos Santos showed many things previously unseen in absorbing his first loss in 10 Octagon performances:

A granite chin, resilience and an amazing ability to keep battling despite being completely exhausted and possibly out on his feet.

Looking back on the bout -- and I'll have to watch it again to confirm my theory -- but I'm pretty sure I've never seen a guy look so exhausted, so early, and absorb so much punishment while battling over five rounds. If you had to take odds in the first round whether or not dos Santos could survive for more, you would've gotten some long ones.

He simply looked spent three minutes in.

Perhaps it was the shock of Velasquez's opening-moments assault, where he simply jumped on the Brazilian and never relented, getting the better of exchanges and making him work at a fast rate. Whatever the issue, almost every other heavyweight would've broken.

But, dos Santos didn't.

Even terribly gassed by the third, he still managed to display amazingly good takedown defense, wresting himself free time and again as Velasquez uncorked an endless series of attempts to get him down, eventually getting them through sheer attrition. It's scary to think of how good dos Santos might have been last night, if he'd had the kind of conditioning he's shown in previous fights.

He was exhausted and unable to even hold his hands up in defense, his sole method of defense was either pulling away or eating shots as they bounced off his head.

It's to Velasquez's credit that he was able to implement and stick with a gameplan that seemed almost foolhardy in the opening moments -- I was sure dos Santos was going to catch him with something, given how aggressively Velasquez was pressing forward, particularly when he left gaping holes in his defense, but perhaps "Brown Pride" knew something we didn't.

Dos Santos might have a bit of front-runner in him offensively, and be the kind of guy who doesn't necessarily adjust well once he's taken out of his groove, but he's one hell of a tough guy to finish, and last night, ironically enough, showed the kind of mettle we always wondered whether or not he had.

It's just too bad his cardio and offensive weren't in the fight long enough for it to matter outside of a moral victory.

Would-be adoptive parents look beyond Russia

NEW YORK (Reuters) - Russia's new ban on U.S. adoptions is the latest setback for hopeful American parents as countries increasingly impose restrictions.

Other countries, including China and Guatemala, have erected hurdles for adoptive families as they create their own domestic adoption programs. The signing of the Hague Convention on adoption in 2008 drastically improved regulation of the process, which had been rife with corruption. But it has also led to a slowdown in adoptions or shutdowns in some countries. Internal politics and abuse concerns are additional reasons why countries have tightened controls.

In 2004, U.S. citizens adopted 22,991 children who had been born abroad, an all-time high, according to Adoptive Families magazine. By 2011, that number had fallen to 9,319. For a graphic view of how international adoptions have fallen in various countries, see http://link.reuters.com/tut84t

There are still other options for Americans wanting to adopt an international child. Bulgaria, Colombia and many African nations are some of the new, go-to countries for U.S. adoptions.

But even that's not a sure thing. For would-be adoptive parents the best bet is to widen their search to include special needs kids, sibling groups and older children.

AFRICA'S ADOPTION EXPLOSION

Africa, which represented 22 percent of adoptions in 2009, is expected to be a bigger player in the future. "A decade ago, there were very few adoptions (in Africa)," according to Susan Soonkeum Cox, vice president policy and external affairs at Holt International, a Christian adoption organization. "Now, there's an explosion."

African countries seeing an increase in adoptions include South Africa, the Democratic Republic of the Congo, Ghana, Kenya and Ivory Coast.

Adoptions in Ethiopia, meanwhile, have declined from a peak of 2,511 in 2010 as the country overhauled its oversight process. But it is still a viable option, Cox said.

Cox advises working with an adoption agency that has staff on the ground in Africa and other countries to handle paperwork and advocate for U.S. families.

Other countries that still welcome American adoptions include Bulgaria and Colombia, said Megan Montgomery, international adoption coordinator for Adoption Star, based in Amherst, New York. Adoption Star primarily deals with adoptions from Bulgaria, a country that has gone from five placements in 2008 to 75 adoptions in 2011.

Placements from Vietnam and Cambodia, which shuttered their U.S. adoption programs, should resume soon, adoption experts say.

FAMILIES CAN'T FLIP A SWITCH

Adoptions of Russian children peaked in 2004, according to Dale Eldridge, coordinator of adoptive services at Jewish Family Services' Adoption Choices, a non-profit adoption program based in Framingham, Massachusetts. Right now, fewer than 50 U.S. adoptions of Russian children are formally in the works while another 250 U.S. families have identified kids they would like to adopt, adoption experts said.

Unfortunately, families that already have started an adoption in Russia can't just flip a switch and redirect their efforts to another country. "I wish it was as simple as taking some families who have been waiting (for Russian children) to just move over to another country," said David Nish, chief program officer at Spence-Chapin, a U.S.-based adoption agency that finds homes for children in the United States and around the world. "But it's a whole other process."

That's because every country has its own eligibility requirements. Criteria can include parents' marital status, age of the parents, employment, financial status, medical issues, and even the age difference between the adoptive parents and adoptee child. The adoption process remains restrictive for single-sex couples.

And the cost can be prohibitive. For example, the median fee in 2011 was $8,000 for the Dominican Republic, $15,355 in Panama and $26,063 in South Africa, according to the U.S. State Department's Intercountry Adoption Annual Report. Adoption fees for many of the 30-plus countries on the State Department's list are in the range of $20,000. That's not including travel costs.

Even so, international adoptions are often cheaper than domestic ones for newborn babies, which can cost $40,000 or more.

OLDER CHILDREN

To speed up the process, would-be adoptive parents should consider a school-age child, experts say.

According to the State Department, 233,934 international adoptions were made by Americans from 1999 to 2011. Nearly 94,000 of those adoptions involved children under the age of one. Just about 20,000 children aged three or four were adopted during that period. And for kids aged 5 to 12, it was 29,712.

The benefit of adopting a school-age child is that it is easier to identify developmental and emotional problems ahead of time. "There's more you can do to prepare and put resources in place to support what they need," Spence-Chapin's Nish said.

School-aged children can be challenging if pre-adoptive experiences affect their development, he said.

A special needs child is also a possibility. One way to fast-track an international adoption may be to apply for a child with known medical or special needs, said Adoption Star's Montgomery. "For families with resources, it can be great option," Montgomery said. "Of course, you really have to find the right family to take on that kind of known medical need."

Special needs can range from a baby born with a minor medical problem, such as a cleft palate, to more serious issues, such as a heart condition, blindness or spina bifida. "It's not about families getting a child quicker," Nish said. "It's about a family accepting a child into their household that they can provide for and love and nurture."

China's Waiting Child program, which includes children who have special needs or correctable medical conditions or are part of sibling groups, has wait times that are typically much shorter than the traditional program, according to Adoptive Families magazine. In 2011, more than half of adoptions from China were through this program.

Would-be parents must be prepared to wait. The Associated Services for International Adoption, a non-profit adoption group, says the wait time for an adoption referral in China is 73 months as the country has clamped down on U.S. adoptions. "If the wait time is becoming impractical, it's better to close the intake process" and start again, advised Holt's Cox.

Tracy Downey and her husband, Jason, who live in suburban Des Moines, Iowa, tried to go the traditional international Chinese adoption route in 2006. But after waiting for 18 months to bring home a baby from China, Tracy switched gears and started combing the official Chinese list of children with special needs along with additional lists from adoption agencies and orphanages.

The Downeys have since adopted a daughter, Angel, along with two sons - Corban and Tegan - from China, all with large, potentially disfiguring moles known as a giant congenital nevi. They started the process to bring home the two boys, now aged 3-1/2, last January. It took about 10 months.

Aside from their large moles - which are on two of the children's faces and on the other's lower body - all three kids are healthy and thriving, Tracy said.

"If we wanted a non-special needs child, we'd still be waiting," Tracy said.

Everywhere else in the world, they understand that. The Europeans have had it figured out for almost 40 years. The Chinese have just inaugurated the longest ever high-speed rail line. Spain has linked all their major cities with high-speed rail. And ? Oh, yes ? they?re building a new high-speed rail line in Uzbekistan! Meanwhile, here in the U.S., we?re still being subjected to people blathering that high-speed rail is ?just another government boondoggle?. At least 15 killed in sect attack in north Nigeria

MAIDUGURI, Nigeria (AP) ? Gunmen suspected to belong to a radical Islamist sect attacked a village in northeast Nigeria, tying up men, women and children before slitting their throats, killing at least 15 in the troubled region's latest attack, witnesses said Saturday.

The assault happened early Friday morning in the village of Musari on the outskirts of Maiduguri, the city where the sect known as Boko Haram first launched its guerrilla campaign of shootings and car bombings against Nigeria's weak central government. The gunmen shouted religious slogans and later ordered those there to be gathered up into a group, said Mshelia Inusa, a primary school teacher in the village.

"We heard some people chanting, 'God is great, God is great' amid sounds of banging on doors of houses at about 1 a.m.," the teacher said. "A voice was heard ordering people to be slaughtered and also voices of children were heard screaming."

Inusa said he and others later saw corpses with their hands tied behind their backs and their throats cut.

Later Friday morning, an ambulance arrived at the State Specialists Hospital in Maiduguri, accompanied by a group of military vehicles, a security guard said. Agitated soldiers ordered people away, but the guard said he counted at least 15 bodies being brought into the facility's morgue.

The guard spoke on condition of anonymity out of fears of angering either the military or the sect.

Lt. Col. Sagir Musa, a military spokesman, later issued a statement saying only five people had been killed in the village during the attack. However, military and police officials routinely downplay casualty figures because they are under increasing pressure from their superiors to minimize the perceived effects of the ongoing attacks by Boko Haram.

Boko Haram, which speaks to journalists through conference calls at times of its choosing, could not be immediately reached for comment Saturday. However, the attack mirrored other assaults carried out by the group as it expands its operations outside of cities in the northeast into rural towns and villages, where the security presence remains light and contact with the outside world remains difficult as the sect has destroyed a number of mobile phone towers recently.

The sect, whose name means "Western education is sacrilege" in the Hausa language of Nigeria's Muslim north, wants the nation to enact strict Shariah law and release its imprisoned members. Despite a heavy military and police presence, the sect's adherents have continued to launch frequent attacks.

More than 780 people have been killed in Boko Haram attacks so far this year, according to an Associated Press count, making 2012 the worst year of violence attributed to the group. Boko Haram also has loose connections with al-Qaida in the Islamic Maghreb and Somalia's al-Shabab, according to Western military officials and diplomats.

Suspected Boko Haram gunmen also attacked another village Friday in Adamawa state on its border with neighboring Cameroon. Witnesses said that attack focused on the town of Maiha, where gunmen also shouted praises to God while setting fire to government buildings, a school and a prison. At least 35 prisoners were released from the prison in the attack, though 11 had been recaptured, police spokesman Mohammed Ibrahim said Saturday.

Ibrahim said a civilian and a police officer were killed during the fighting.

And violence continued around the central Nigerian city of Jos, where ethnic, religious and political rivalries have caused mass killings in recent years. Authorities said at least seven had been killed in recent days around Christian villages in the rural plateau. Police said they were investigating the attacks.

Hard to believe, but we have reached the end of the NFL?s 2012 regular season. Was it not that long ago that we had replacement referees and the Arizona Cardinals were 4-0? Yet here we are, days away from that last Sunday until next September in which all 32 teams will play a real game. Savor the moment.

Week 17 offers numerous playoff scenarios, the last two playoff berths, and one more attempt to rewrite the NFL record book. Here is your handy guide to what to watch for this Sunday. All 16 games are divisional rematches.

AFC South
The Houston Texans (12-3) have been in the driver?s seat of the AFC all season, yet a loss in Indianapolis (10-5) will likely push them all the way to the No. 3 seed, which means no first-round bye.

It is a very important game for Houston, which just beat the Colts 29-17 in a Week 15 game dominated by J.J. Watt. He has 20.5 sacks, eyeing Michael Strahan?s record of 22.5 sacks set in 2001.

For the Colts, Bruce Arians had one of the finest runs ever as an interim coach, leading the team to a 9-3 record. Chuck Pagano triumphantly returns to the sidelines this week as his battle with leukemia continues to inspire this team of underdogs.

Despite their -42 scoring differential, the Colts are 10-5. They have done so by going 9-1 in games decided by 1-7 points. Andrew Luck has already set the rookie passing record (4,183 yards), and has tied the regular season record with seven game-winning drives.

While the Colts are locked into the No. 5 seed, they are still a young team that can use the experience against a quality opponent. It is hard to imagine they will not go all out for the win with Pagano?s return. The Colts are 10-0 all time at home against Houston.

You can say Peyton Manning?s injury last year helped pave the way for drafting Luck. Now Manning will be looking for some help in return, as a Colts? victory over Houston is the path for Manning?s Broncos to get the No. 1 seed this year.

Jacksonville (2-13) has a slight chance of securing the No. 1 pick in the draft with a loss to Tennessee (5-10). The only other need is a Kansas City win in Denver, so good luck there. Think of your imminent future with Tim Tebow as a consolation prize, Jacksonville fans.

AFC North
With Baltimore (10-5) clinching the division last week, there is little on the line against playoff-bound Cincinnati (9-6), which is locked into the sixth seed. Ray Lewis is back, but he is not expected to play on Sunday. The Ravens have won four straight over the Bengals, who are making back-to-back playoff trips for the first time since 1981-1982.

A Baltimore win combined with a New England loss would give the Ravens the No. 3 seed, but that is not a likely scenario. Besides, that would mean the Ravens would host these very same Bengals a week later, and it is hard to beat a team twice in one week.

Only pride is on the line for Pittsburgh and Cleveland. The Steelers (7-8) will look to avoid their first losing season since 2003, while the Browns (5-10) have not swept the Steelers since 1988.

AFC West
In a season full of inconsistent play, the Denver Broncos (12-3) are a glimmer of hope. They have won 10 straight games by at least seven points. All other AFC winning streaks combined add up to just eight games. Ranking top five on both offense and defense, Denver might be the most complete team in the league.

Peyton Manning will look to cap off his campaign for a fifth MVP award. His 12 consecutive games with a passer rating of at least 90.0 is the third longest streak in NFL history. Only Aaron Rodgers (13 games in 2011) and Manning again (15 games in 2004) had longer streaks.

Consistency is the name of the game, and that?s what Manning has brought to Denver as it looks towards a run at the Super Bowl. A win will give the Broncos a first-round bye.

The Chiefs (2-13) have consistently been bad this year, and will likely have the first pick in the draft. If they should fail to get a takeaway, they will tie the NFL record for fewest takeaways (12) in a 16-game season. The 2006 Washington Redskins also had 12 takeaways.

San Diego (6-9) plays Oakland (4-11), which should be the swansong for Norv Turner?s run there. Turner is 55-40 (.579) and 3-3 in the postseason as San Diego?s head coach.

AFC East
With a home finale against Miami (7-8), New England (11-4) can be anywhere from the No. 1 to No. 4 seed depending on Sunday?s results. If the Patriots score at least 32 points, they will have the second-highest scoring season in NFL history. Miami is looking for its third non-losing season since 2004.

Buffalo (5-10) and the Jets (6-9) will play a Week 1 rematch. The season cannot possibly end any faster for these two teams.

NFC South
Atlanta (13-2) can tie its 1998 Super Bowl team for the best record in franchise history with a win over reeling Tampa Bay (6-9), which has lost five straight games. The Falcons have already clinched the NFC?s No. 1 seed.

New Orleans (7-8) can end its troubled season with a win over Carolina (6-9), which would give the Panthers a second straight 6-10 finish.

Cam Newton needs one touchdown pass to join Dan Marino, Peyton Manning and Andy Dalton as the only quarterbacks to throw at least 20 touchdowns in each of their first two seasons. Meanwhile, Drew Brees needs one touchdown pass to become the first player in NFL history with consecutive seasons of 40 or more touchdown passes.

Brees only needs 219 yards to reach 5,000 yards passing for the third time in his career. Matthew Stafford (305) and Tony Romo (315) also are in position to throw for 5,000 yards, which would match last season?s total of three quarterbacks hitting the milestone.

NFC North
The NFC North will have a huge impact on the final playoff seeds as both games are involved with many of Sunday?s scenarios. They also will feature two of the league?s best players looking for a 2,000-yard milestone.

Green Bay (11-4) travels to Minnesota (9-6) in a late afternoon game. With a win, the Packers will clinch the No. 2 seed in the NFC. The Vikings need a win just to make the playoffs, which is their best scenario.

A Minnesota win could very well mean these teams will meet again next week, but it will not be easy. The Packers are hot, winners in nine of their last 10 games, and have won five straight against the Vikings.

Minnesota just pulled off an upset in Houston, even without Adrian Peterson having his best game. Peterson needs 102 rushing yards to become the league?s seventh 2,000-yard rusher, and will need 208 yards to break Eric Dickerson?s all-time record (2,105 yards).

Peterson had 210 yards when these teams met in Week 13, but the Packers won. For the Vikings to make the playoffs, they are going to need Christian Ponder to step up.

The Chicago Bears (9-6) are still alive. They have to take care of the Lions (4-11), and hope for the Vikings to lose. Should Chicago falter, it will become just the fourth team to start 7-1 and fail to make the playoffs since 1978. The Bears would join the 1987 San Diego Chargers, 1988 New Orleans Saints and 1996 Washington Redskins.

Standing in their way is a pass-happy Detroit team. Matthew Stafford needs seven pass attempts to surpass Drew Bledsoe?s record of 691 passes in 1994. Unless he is injured, Stafford will become the first quarterback ever to throw 700 passes in a season. He can also break Bledsoe?s record for most drop backs in a season. Bledsoe had 757 while Stafford is currently at 745.

Detroit needs just 12 pass attempts to break the team record for a season, which is currently held by the 1981 Minnesota Vikings (709 attempts).

The beneficiary of all these attempts is Calvin Johnson, who now holds the record for most receiving yards in a season with 1,892 yards. He needs just 108 to become the first player ever with 2,000 receiving yards, and you figure Detroit will do all it can to get him there.

NFC West
Despite their bad loss on Sunday night, the San Francisco 49ers (10-4-1) should have little trouble clinching the NFC West with a win at home over Arizona (5-10). The banged-up 49ers will just have to root for Minnesota to take care of the Packers in order to get the No. 2 seed and what appears to be some needed rest.

Seattle (10-5) is already in the playoffs, and will likely be the No. 5 seed. Though they lost to the Rams (7-7-1) way back in Week 4, this is a much stronger team now.

Not only is Seattle one of two teams (Atlanta) that are 7-0 at home this year, but their home scoring differential of 141 is easily the best in the league. Denver is a distant second at 94 points.

Russell Wilson needs two touchdown passes to break Peyton Manning?s rookie record of 26 touchdown passes set in 1998. Seattle has scored 150 points over the last three weeks, and is +11 in turnover differential since their bye week (4-1 record).

For the Ram, a win would give them their first winning season since 2003. That would be a strong way to end Jeff Fisher?s first season in St. Louis, but not a likely outcome.

NFC East
Finally we have the media darlings of the NFC East. For the New York Giants (8-7) to make the playoffs and defend their championship, they need a lot of help.

Not only do the Giants need to beat the Eagles (4-11), but they need Chicago, Minnesota and Dallas to lose. Technically they can get in if Dallas ties, but that?s not going to happen. They will be extremely fortunate just to get all the other results to go their way.

While most probably expect the Vikings and Cowboys to lose this week, and for Chicago to potentially lose, there is no guarantee the Giants can take care of the Eagles, who will start Michael Vick this week.

It has been a very inconsistent season for the Giants, who have looked like the best and worst team in the league at different moments throughout the season. The Giants would become the seventh defending Super Bowl champion since 1990 to miss the postseason should their miracle scenario not play out.

Then there is the 256th and final regular season game of the 2012 season: Dallas Cowboys (8-7) at Washington Redskins (9-6) for the NFC East title on Sunday Night Football.

For the third time since 2008, the Cowboys go on the road in Week 17 for a "win and you?re in" playoff game against one of their NFC East rivals. The last two times have not gone well, but this Dallas team is different. It has been winning a lot of tough games in the second half of the season, and Tony Romo is playing very well.

Also playing well is Redskins quarterback Robert Griffin III, who can clinch rookie records for completion percentage (66.4 percent) and passer rating (104.1) with a good performance. Griffin making the playoffs would mean three rookie quarterbacks (Andrew Luck, Russell Wilson) in the postseason for the first time ever.

Not sure which buttons Mike Shanahan pressed during the team?s bye week, but Washington has turned a 3-6 season into a possible seven-game winning streak that will allow the Redskins to host a playoff game for the first time since the 1999 season.

While it is do-or-die for Dallas, the Redskins can still make the playoffs with losses by the Bears and Vikings, which they will know before the game starts. But if they want to do things the right way, they take care of this one at home.

Either way, let?s just hope for a competitive final game to close out this wild regular season.

Justice reaches settlement with Penguin on e-books

WASHINGTON (AP) ? The Justice Department announced Tuesday it has reached a settlement with Penguin Group (USA) Inc. in its lawsuit accusing the nation's largest book publishers of colluding with Apple Inc. to raise e-book prices on customers.

The settlement, if approved by a federal judge, leaves Apple and Holtzbrinck Publishers LLC, which does business as Macmillan, as the only defendants standing against the federal government's charges that Apple, the multimedia and computer giant, conspired with several publishers in the fall of 2009 to force e-book prices several dollars above the $9.99 charged by Amazon.com on its popular Kindle device.

The Justice Department, which sued in April, settled with Hachette Book Group, Inc., HarperCollins Publishers LLC and Simon & Schuster Inc. earlier this year. The trial is scheduled to begin in June.

"The proposed settlement with Penguin will be an important step toward undoing the harm caused by the publishers' anticompetitive conduct and restoring retail price competition so consumers can pay lower prices for Penguin's e-books," said Jamillia Ferris, chief of staff and counsel at the Justice Department's antitrust division.

Apple Inc. has said the government's accusation that it conspired with major book publishers to raise the price of e-books is untrue.

The proposed settlement was filed in federal court in New York.

The settlement had been expected by some industry observers as a means to simplify Penguin's impending merger with Random House, which is not a defendant in the case. That deal would create the world's largest publisher of consumer books.

Under the settlement, Penguin "will be prohibited for two years from entering into new agreements that constrain retailers' ability to offer discounts or other promotions to consumers to encourage the sale of the Penguin's e-books," and must submit to "a strong antitrust compliance program" that includes telling federal officials about any joint e-book ventures or any communications with other publishers, Justice Department officials said.

The Justice Department's lawsuit stems from agreements reached between major publishers and Apple in 2010 that allowed publishers to set their own prices for e-books, an effort to counter Amazon's deep discounts of best sellers. The department and 15 states said Apple and the publishers cost consumers more than $100 million in the past two years by adding $2 or $3, sometimes as much as $5, to the price of each e-book.

E-books are believed to comprise around 25-30 percent of total book sales.

Penguin Books is scheduled to merge with Random House, which is owned by German media company Bertelsmann. The resulting combination will have around a quarter of the market for consumer books. "Should the proposed joint venture proceed to consummation, the terms of Penguin's settlement will apply to it," the department said.

Last week, the European Union's competition watchdog accepted proposals by four publishers and Apple to end agreements that set retail prices for e-books ? a practice the EU feared violated competition rules. The agreement was legally binding on Hachette Livre; Harper Collins; Simon & Schuster; and Verlagsgruppe Georg von Holtzbrinck, which owns Macmillan. That deal was also binding on Penguin.

Back in March of this year I wrote a story entitled?Direct Mail: Alive And Kicking. It would appear that direct mail is not only alive and kicking, it?s going ?high tech.?

Well, in a manner of speaking.

If you?re a proponent of traditional advertising mediums like direct mail,?email marketing, print, or radio, it?s easy to feel like you are being left out of the technological loop. After all, it seems there is a leap forward every other day for sexy marketing venues like pay per click, search engine optimization, and social media, and so on.

On one hand, you like traditional media exactly because it DOES NOT change every other week. It?s proven, and the results are (somewhat) predictable. This is good. You don?t want to go throwing money at some new fangled marketing scheme and then sit back, fingers crossed, hoping it produces a return.

On the other hand, innovation is good. Innovation is GREAT, actually. Why settle for doing things the same old way when there is an alternative available that offers a BETTER return for LESS money?

And it?s exactly this innovation that many business owners feel they are missing out on if they stick to their traditional marketing guns.

But is this really the case?

As it turns out ? no. Case in point: the direct mail industry is currently undergoing a massive shift in the way it handles clients? campaigns. Gone are the days of, ?Your cards are in the mail? Good luck.? Here to stay are the days of, ?Your cards are in the mail. They will arrive in prospects? mailboxes on the 23^rd. Go to this?web address?to see how many responses you receive, and to listen to recordings of your sales calls. Also, we took care of your online follow-up for you. Don?t worry about that.?

Yes, it?s a little bit of a mouthful. But that last part ? about the online follow-up ? that?s the part that is revolutionary in the industry. The other things like tracking your mail and recording phone responses are advances, but they?ve been around for a while.

Direct Mail +?Google?? How It Works

We live in a world where the front door to virtually every business is their website. This is as true today of dentists and landscapers as it is of online retailers. If your website stinks, chances are your marketing will stink too. The direct mail industry is figuring this out, which is why many of the hands-on, innovative direct mail houses have started to offer web design services to complement their bread and butter.

This, in and of itself, is an innovation ? and a huge one. But not the latest?

What happens when a prospect receives an intriguing offer on a postcard, goes online to read more about the deal, gets distracted, and never goes back to the business? site? Used to be they were gone forever, but not anymore.

Google?introduced a product called Remarketing for just this purpose.?Google Remarketing?is a program that is connected to?Google?Adwords, and it works like this:

1. A business adds the?Google?Remarketing Code to their website
2. A prospect comes to the site, but leaves before taking the action the business wants them to take (whether that is completing a transaction, filling out a form, or whatever)
3. Google?knows this (thanks to the code)
4. Google?displays specific follow-up advertisements to that prospect as the continue to cruise other sites, reminding them to go back to the business? site and finish what they started
5. The business doesn?t pay unless the prospect actually clicks the ad

The direct mail industry saw this as an opportunity to innovate and get better returns for their clients, so they bundled?Google?Remarketing in with standard direct mail services like postcards.

This is a small (but not insignificant) step for direct mail providers and an ENORMOUS step for direct mail marketers. Think about it this way: let?s say that for every person that calls you off of your direct mail piece, another person goes to your website, but decides not to call. This isn?t very hard to imagine. Those web visitors used to mean absolutely nothing to you. They were as useless as the person who threw away your ad without looking at it. NOW, that person is a legitimate lead being courted online by follow-up ads, just like your phone leads are courted by emails or phone calls.

It?s very cool for sure and one of the best companies out there who have seamlessly incorporated direct mail with?Google?is?postcardmania.com?who offer what they refer to as ?Direct Mail 2.0?? with the declaration that ?the old way of handling direct mailing services is ancient history.?

So, yes, traditional marketing methods can innovate, even if they don?t get the airtime that sparkly new options get. Yes, the world of direct mail has finally integrated with the great?Google. And YES, the next big thing in direct mail is integration with?Google?Remarketing.

At least until the next thing comes along.
